BlueGuard Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the services provided by BlueGuard ("BlueGuard," "we," "us," or "our"). By enrolling in, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Description of Services
BlueGuard provides software-based water usage monitoring, leak detection analytics, and alert services using available utility and meter data. Certain subscriptions or programs may include limited plumbing repair services as described in Section 7.
3. Authorized Agent Designation
By enrolling, you authorize BlueGuard to act as your authorized agent for the limited purpose of accessing water utility usage and meter data to provide monitoring, leak detection, alerts, and loss-prevention services. This authorization does not grant BlueGuard authority to modify utility account terms, billing information, or service settings.
4. Communications & Alert Authorization
4.1 Consent to Communications
By enrolling in the Services, you expressly consent to receive communications from BlueGuard, including communications delivered via:
- SMS / text message
- Phone calls (including automated or prerecorded calls)
- In-app notifications
- Push notifications or similar alert mechanisms
These communications may be sent using automatic dialing systems, prerecorded voice technology, or automated messaging systems, where permitted by law.
4.2 Purpose of Communications
You authorize BlueGuard to contact you for purposes including, but not limited to:
- Leak detection alerts and anomaly notifications
- Urgent or emergency communications related to potential water loss
- Service status updates
- Repair coordination and contractor dispatch
- Account, onboarding, or authorization confirmations
- Program, subscription, or service-related notices
Communications may occur at any time, including outside standard business hours, where reasonably necessary to mitigate potential water damage.
4.3 Emergency & Time-Sensitive Contact
You acknowledge and agree that time-sensitive communications are critical to the Services and that BlueGuard may attempt to contact you multiple times and through multiple channels if a potential leak or abnormal condition is detected.
Failure to respond to alerts or communications may limit BlueGuard's ability to mitigate loss or coordinate repairs.
4.4 Telephone Consumer Protection Act (TCPA) Consent
You expressly consent, for purposes of the Telephone Consumer Protection Act (TCPA) and similar state laws, to receive calls and messages (including autodialed and prerecorded communications) from BlueGuard at the telephone numbers you provide.
This consent:
- Is not a condition of purchase
- Applies to service-related and emergency communications
- Remains valid unless and until revoked as described below
4.5 Email Communications
You consent to receive service-related emails from BlueGuard. You may opt out of non-essential emails, but service, alert, and account-related emails are mandatory for proper operation of the Services.
4.6 Accuracy of Contact Information
You represent and warrant that:
- The contact information you provide is accurate
- You are the authorized user of the phone numbers and email addresses provided
- You will promptly update your contact information if it changes
BlueGuard is not responsible for missed alerts or communications resulting from outdated or incorrect contact information.
4.7 Opt-Out & Revocation of Consent
You may revoke consent for:
- SMS by replying "STOP"
- Email marketing via unsubscribe links
- Calls by contacting support
However, revoking consent for certain communications may materially impair the Services, including the ability to deliver leak alerts or coordinate repairs. If essential communications are disabled, BlueGuard may suspend or terminate the Services.
5. No Guarantee of Detection
BlueGuard does not guarantee that:
- All leaks or plumbing failures will be detected
- Alerts will be timely or effective
- Water loss or property damage will be prevented
Monitoring depends on third-party data sources, reporting intervals, connectivity, and conditions beyond BlueGuard's control.
6. User Responsibilities
You are responsible for:
- Maintaining plumbing systems in good working order
- Responding promptly to alerts
- Performing regular inspections and maintenance
- Mitigating known or visible plumbing risks
7. Assumption of Risk
You acknowledge that water leaks and plumbing failures may occur regardless of monitoring services. You assume all risks associated with property ownership, plumbing systems, and water usage.
8. Repair Services (Limited Benefit; Strict Scope)
8.1 Repair Benefit Overview
Certain BlueGuard subscriptions or programs may include plumbing repair services at BlueGuard's expense (the "Repair Benefit"). The Repair Benefit, where offered, is voluntary, limited, and subject to all conditions below.
8.2 Maximum Repair Amount (Hard Dollar Cap)
BlueGuard's total financial responsibility for any covered repair shall not exceed a maximum dollar amount per covered incident (the "Repair Cap"), as specified in the applicable subscription details, program materials, or carrier-sponsored agreement.
The Repair Cap includes all labor, materials, parts, diagnostic work, and access-related work performed in connection with the covered repair.
Once the Repair Cap is reached, BlueGuard has no further obligation, and any additional costs shall be the sole responsibility of the property owner.
8.3 Covered Repairs (Strict Leak-Stoppage Scope)
The Repair Benefit applies only to the repair of a confirmed active leak originating from an internal pressurized potable water supply line located within the structure.
Covered repair work is strictly limited to the work reasonably necessary to:
- Isolate the source of the active leak
- Stop active water flow
- Repair or replace the failed section of pipe or directly associated fittings, couplings, valves, or short supply connections
- Restore water service
Covered repairs may include replacement of ancillary plumbing components directly involved in the leak, solely to the extent necessary to stop the active leak and restore water service.
Covered repairs also include repair or replacement of toilet components (including fill valves, flappers, supply lines, and shut-off valves) when the failure is detected through BlueGuard's monitoring system. This coverage is limited to the components necessary to stop the detected water loss and does not include replacement of the toilet fixture itself.
Except as expressly provided above, covered repairs do not include replacement of fixtures, appliances, or end-use devices, even if such items are connected to the leaking line.
If permanent repair is not feasible within the applicable Repair Cap, BlueGuard may perform temporary or partial repairs sufficient to stop active water flow and mitigate damage, with no obligation to complete permanent repair or system restoration.
8.4 Explicit Exclusions
The Repair Benefit does not include, and BlueGuard shall have no responsibility for:
- Fixtures, appliances, or equipment (including faucets, water heaters, dishwashers, and washing machines), except toilet components expressly covered under Section 8.3
- Irrigation systems, hose bibs, sprinkler lines, or exterior plumbing
- Sewer, drainage, wastewater, or non-pressurized lines
- Pipe replacement beyond the failed section
- System upgrades, rerouting, or redesign
- Code upgrades or compliance changes
- Preventive, elective, or recommended repairs
- Repairs to unrelated plumbing issues discovered during service
8.5 Access-Related Damage
Repair work may require access through walls, floors, ceilings, cabinets, or other building materials to reach the failed pipe.
BlueGuard's responsibility is strictly limited to repairing the plumbing failure itself. BlueGuard does not cover:
- Drywall, flooring, cabinetry, tile, paint, insulation, or finishes
- Restoration, cosmetic repair, or reconstruction
- Mold remediation or water damage restoration
Any access-related damage is an incidental consequence of plumbing repair and is the responsibility of the property owner.
8.6 Independent Contractors
All repair services are performed by licensed independent third-party plumbing contractors. Such contractors are not employees, agents, or representatives of BlueGuard.
BlueGuard does not warrant or guarantee the workmanship, materials, or outcomes of any repair services.
8.7 Discretion and Termination of Work
BlueGuard reserves the right, in its sole discretion, to:
- Determine repair eligibility
- Limit the scope of covered work
- Decline or discontinue repairs that are unsafe, impractical, or outside program scope
- Cease work immediately upon reaching the Repair Cap
9. No Insurance, Warranty, or Home Protection Plan
BlueGuard is not an insurance company, warranty provider, or home protection plan. Nothing in these Terms creates insurance coverage or guarantees against loss, damage, or plumbing system condition.
10. Limitation of Liability
To the maximum extent permitted by law:
- BlueGuard's total liability arising out of or related to the Services shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the claim
- BlueGuard shall not be liable for indirect, incidental, consequential, special, or punitive damages, including property damage, loss of use, or loss of value
11. Indemnification
You agree to indemnify and hold harmless BlueGuard from any claims, damages, or liabilities arising out of:
- Misuse of the Services
- Violation of these Terms
- Failure to maintain property or plumbing systems
12. State-Specific Provisions
California
Nothing in these Terms limits consumer rights that cannot be waived under California law. Liability limitations apply only to the maximum extent permitted.
Texas
These Terms are governed by Texas law. Venue shall lie exclusively in courts located in the State of Texas.
Florida
Any provision found unenforceable under Florida law shall be severed, and the remaining Terms shall remain in full force and effect.
13. Termination
You may terminate the Services at any time. BlueGuard may suspend or terminate access for violation of these Terms or if required by law.
14. Changes to Terms
BlueGuard may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
